1. What Agentile is, and who runs it

Agentile is a wiki of interactive pages. You — or a software agent acting for you — write the data for a page; the platform decides how that data is laid out and drawn.

It is run by one person, Landice Fu, in Taiwan, as a personal project. There is no company behind it, no staff and no support desk. Below, “we”, “us” and “our” mean that person. “You” means the person holding the account.

Using Agentile means you accept these terms. If you do not accept them, do not use it.

2. Who may use it

Agentile is invite-only. Signing in is by Google account, and only addresses on an access list held in the service’s configuration can get in. Being able to reach the site is not an offer to serve you.

You must be old enough to enter into a contract where you live, and at least 16.

3. Your account

Your account is tied to one Google account. We never see and never hold a password.

You are responsible for what happens under your account. That includes the API tokens you create: a token is a credential, and anyone holding one can do through the API anything you can do. If one leaks, revoke it in Settings.

You are also responsible for who you share a page with, and for what you make public. A public page is readable by anyone who has the link — signed in or not — and by anything that crawls the web.

4. Your content is yours

Everything you put on Agentile remains yours. We claim no ownership of it. The licence in the next section is the limited permission we need in order to run the service, and nothing more.

5. The licence you give us

To show you a page we have to store it, copy it between systems, index it so you can search it, lay it out, and — when the platform’s own data formats change — rewrite the stored form of it so that it still displays correctly.

So you give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, index, display and modify (for formatting purposes only), solely in connection with operating and providing the Service.

Five of those words are the whole limit: for formatting purposes only. The licence does not let us change what your page says, publish it, sell it, train anything on it, or show it to anyone you have not shared it with. It lasts while your content is on Agentile and ends when the content is deleted.

6. What you may not store here

Do not store sensitive personal data on Agentile. This is a real limit rather than a formality. In particular, do not store:

• health, medical or genetic records;
• payment card numbers, bank credentials, or passwords for other services;
• government identifiers — national identity numbers, passport numbers;
• data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, sex life or sexual orientation;
• biometric data used to identify someone;
• anything about a person under 16;
• anything you are under a legal or professional duty to keep confidential — patient records, client files, classified material;
• anything it is unlawful to hold or to distribute where you are or where we are.

The reason is stated plainly: Agentile is a personal project with a single operator, and it is not built or staffed to the standard those categories deserve. If you store them here anyway, that is your decision and your responsibility, and we may remove the content or close the account under section 10.

7. Acceptable use

Do not:

• break into, probe, overload or interfere with the service, or with anyone else’s account or content;
• use it to send spam, malware or phishing, or to host any of those;
• store or distribute material that is illegal where you are or where we are;
• impersonate anyone, or misuse access someone else gave you;
• resell access, or run automated traffic out of proportion to using the service — API calls are rate-limited and storage quotas apply;
• abuse people. Verbal, written or other abuse — including threats — of the operator or of another user may end the account immediately.

8. When a human looks at your content

Our software processes your content constantly: storing it, indexing it, drawing it, reformatting it. That is what the service is.

A person reads the content of your pages in these four cases and no others:

1. You asked for help. We will ask your permission first, each time, and you can say no.
2. Something broke. An automated process failed partway through. Where we can fix it without looking at your content, we do. Sometimes we have to look at the smallest amount that lets us fix it.
3. An abuse report. Investigating a report about a page or an account.
4. The law requires it. A binding order from an authority with jurisdiction over us.

That is a closed list. We reserve no general right to read your pages. One operator can keep a promise in that shape, which is why it is written this way round rather than the usual way.

Separately from those four, we can see what a server records in order to run: request logs, error messages, sizes, timestamps, and counts. See the Privacy Policy.

9. Changing the service

We may change, add to or remove parts of Agentile. We will do it for one of these reasons and no others:

• to keep the service working — fixing defects and security problems, or responding to a dependency or a provider that changed under us;
• to keep it lawful;
• to change the format a page is stored in, so that pages you already have keep displaying as the platform evolves;
• to add, improve or retire a feature, where the cost of maintaining it is out of proportion to its use.

If a change will materially affect how you use the service, we will tell you before it happens by a notice in the app, and for 30 days after that notice you may close your account at no cost. Changes made only to keep the service working as described here can happen without notice.

10. Suspension and termination by us

Suspension is temporary. The account stops working and you cannot reach your pages. Nothing is deleted. We suspend an account when something needs to stop while we look at it.

Termination ends the account. Your pages are moved to the trash and then permanently deleted on the ordinary 30-day schedule described in the Privacy Policy.

We may suspend or terminate an account for:

• breaking section 6 or section 7;
• a credible report of illegal use;
• abuse of, or a threat against, the operator or another user;
• conduct that puts the service or other people’s data at risk;
• being required to by law.

Except where the law forbids it or a delay would cause harm, we will tell you what happened and why, and give you 30 days to obtain a copy of your content before the account is terminated. Abuse and illegal use get no notice.

If we suspend your account we may write to you with questions. What an unusual pattern of activity was, whether somebody else has reached your account, what a page is for. You have 14 days from the date of that message to reply. If you do not reply within those 14 days we may decide without your answer — keep the account suspended, terminate it, or let the data be deleted on the ordinary schedule above. We say so here, in advance, because it would not be fair to rely on your silence otherwise.

Those are two different clocks and neither shortens the other. The 14 days is how long you have to answer us. The 30 days above is how long you have to get a copy of your content, and it runs from the day we tell you what happened. They run at the same time.

Being suspended does not suspend your rights. You cannot sign in, so you cannot use the export link — write to us instead and we will send you a copy of your data. Everything the Privacy Policy says you may ask for you may still ask for while suspended, and we answer within the same 30 days.

If we close your account and you think we got it wrong, write to us. There is one person to ask, and he will answer.

11. Closing the account yourself

You can delete your account in Settings. The account stops working at once and the data is erased 30 days later; inside those 30 days you can sign in again and undo it. Exactly what happens, and when, is set out in the Privacy Policy under Deleting your account — read that first. Before you delete anything, download a copy of your data; the Privacy Policy under What you can ask us for says how.

12. What we do not promise

Agentile is provided as is. It is free, it is a personal project, and one person runs it in his spare time.

We do not promise that the service will be available, that it will not lose data, that it is fit for any particular purpose, or that it is secure against every attack. There is no uptime commitment, no response-time commitment, and no backup that you control.

We do take security seriously, and the Privacy Policy lists the specific measures we actually take. That list is a more useful thing to read than a disclaimer.

Keep your own copies of anything you cannot afford to lose.

13. Liability

Nothing in this section limits or excludes liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any other liability that cannot be limited or excluded under the law that applies to you; or, where you are a consumer, any of your statutory rights that cannot lawfully be excluded.

Subject to that:

• We are not liable for indirect or consequential loss, for lost profit, lost business or lost goodwill, or for loss of data to the extent you could have prevented it by keeping your own copy.
• Our total liability to you, for everything arising out of or in connection with these terms, is limited to the greater of US$100 and the total amount you have paid us in the twelve months before the claim. Agentile is free, so in practice that figure is US$100. It is a real number rather than “whatever you paid” because whatever you paid is nothing, and a cap of nothing is not a cap.

You are liable to us for loss we suffer because you broke section 6 or section 7.

One thing this section does not do: it does not sign away our own obligation to keep your data secure, and it could not. That duty is owed under the law and not under this contract, and no agreement between us could remove it. What we actually do about security is in the Privacy Policy, and what we will do if it fails is there too.

14. Changes to these terms

These terms carry a version, which is a date. When we change them we publish the new version at /terms and ask you to accept it the next time you use the service; until you do, the service will let you do nothing else. We keep a record of which version you accepted and when.

If you do not want to accept a new version, close your account — section 11.

15. Law, and where a dispute goes

These terms are governed by the laws of Taiwan (R.O.C.), and the Taipei District Court is the court of first instance for any dispute arising from them.

If you are a consumer in a place whose law gives you rights you cannot sign away — including the right to bring a claim in the courts where you live — this section does not take those away.
